Refunds
Refunds are handled on a case-by-case basis. Installation fees are generally non-refundable once work has begun. Equipment refunds may be subject to restocking fees and condition requirements.
8. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that our services will be uninterrupted, secure, or error-free. We are not responsible for any damage to your property or equipment during installation, except as caused by our negligence.
While we strive to provide effective security solutions, no security system can completely prevent all security breaches or incidents.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENERAL HOME SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain damages, so the above exclusions may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless General Home Systems, our officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or post
11. Termination
We reserve the right to suspend or terminate your access to our services at any time, without prior notice, for any reason, including but not limited to:
- Breach of these Terms
- Violation of applicable laws
- Fraudulent or illegal activity
- Non-payment of fees
12. Force Majeure
We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, strikes, telecommunications failures, power outages, or natural disasters.
13. Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts of Ontario, Canada.
Arbitration
Any dispute arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the ADR Institute of Canada, except where prohibited by law.
14. Modifications to Terms
We may modify these Terms at any time by posting the revised Terms on our website. The revised Terms will become effective upon posting.
Your continued use of our services after modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
15. Severability
